Terms of Service

These terms govern your use of House Checkup, operated by Oakden, Ontario, Canada. By using this service you agree to these terms.

Service description

House Checkup provides AI-powered property condition assessments. These are advisory diagnostic tools designed to help homeowners understand potential issues with their property. House Checkup provides three categories of service:

  • AI Condition Assessment — An automated decision-support tool that classifies likely issue types, suggests probable causes, and recommends next steps based on your description and uploaded photos. This is a decision-support tool, not a home inspection or certification of any kind.
  • Building-Science Review — A remote expert advisory service in which a human reviewer analyzes your submission and provides a written assessment. This is a remote, advisory service only. No on-site investigation is performed.
  • Field and Specialist Services — Coordination of on-site assessments, thermal imaging, forensic reports, and specialist attendance. These services are fulfilled by verified independent third-party professionals (see Section 07).

Not a home inspection

House Checkup does not provide home inspections. All services are classified as property condition assessments — advisory diagnostic tools that help you understand potential issues and plan appropriate next steps.

Ontario's Home Inspection Act, 2017 has been passed but is not yet in force as of the date of these terms. No provincial licensing regime for home inspectors is currently operative in Ontario. Notwithstanding this, no service offered by House Checkup constitutes a regulated home inspection under any Ontario or federal licensing regime. Services are performed to professional association standards where applicable.

AI-powered assessments are not a substitute for a professional, on-site inspection by a licensed trade or qualified specialist. If you require an inspection for legal, financial, insurance, or real-estate transaction purposes, you should engage a qualified professional independently.

AI output disclaimer

AI-generated outputs are probabilistic. They are based on patterns in training data and the information you provide. They may be incomplete, incorrect, or inapplicable to your specific situation. AI condition assessments are advisory only — they are not certifications, warranties, or guarantees of any kind.

Do not delay emergency action (fire, gas leak, structural collapse risk, sewage, electrical hazard) based on AI output. Call emergency services (911) or a qualified professional immediately in any emergency situation.

For concerns involving electrical systems, plumbing, structural elements, gas lines, or any system requiring licensed trade work, we strongly recommend engaging a licensed specialist regardless of the AI assessment result.

Limitation of liability

House Checkup provides an advisory and decision-support service. The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not liable for any decisions you make, actions you take, costs you incur, property damage, personal injury, or any other loss arising from or related to your use of reports, assessments, or recommendations delivered through this service.

Our maximum aggregate liability to you for any claim arising from your use of the service is limited to the total fees you paid to House Checkup in the 12 months preceding the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages.

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Indemnification

You agree to indemnify, defend, and hold harmless House Checkup, its operators, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the service; (b) your violation of these terms; (c) your reliance on any assessment, report, or recommendation provided through the service; or (d) any third-party claim arising from actions you took or failed to take based on information obtained through the service.

Payment and refunds

Free plan: No payment required. Nothing to refund.

Pro / Score Tracker plan ($12/month): Billed monthly. You can cancel at any time via your account settings. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for the current billing period.

Building-Science Review: Payment is collected after scope confirmation. A full refund is available if the review has not yet been started and the request is made within 24 hours of payment. No refund is issued once the review has been delivered.

On-site assessment (third-party): A deposit may be required to secure an appointment. The deposit is refundable if you cancel at least 48 hours before the scheduled appointment. No refund is issued on cancellations within 48 hours. Third-party specialist fees are subject to the cancellation terms of the relevant specialist.

Third-party fulfillment

Field services (on-site assessments, thermal imaging, forensic reports, specialist coordination) are fulfilled by independent third-party professionals. These professionals are independent licensed contractors — they are not employees, agents, or representatives of House Checkup.

House Checkup coordinates the engagement and maintains quality standards, but all on-site work is performed by the relevant independent professional under their own professional licence, insurance, and obligations. House Checkup is not responsible for the acts, omissions, opinions, or work quality of independent third-party professionals, except to the extent we have been negligent in selecting or coordinating them.

When you request a field service, only job-relevant information (property address, issue description, photos, and assessment results) will be shared with the assigned professional. See our Privacy Policy for details.

Your obligations

  • Provide accurate information in your submissions. Inaccurate or misleading submissions will affect the quality of the output.
  • Do not upload photos or content that is illegal, defamatory, or violates the privacy of others.
  • Do not attempt to misuse, reverse-engineer, or circumvent any part of the service.
  • You are responsible for verifying any recommendations with a qualified professional before acting on them.
  • You acknowledge that AI condition assessments are advisory only and that you will not treat them as professional inspections or certifications.

Data and privacy

When you submit a condition assessment, your description, selected issue category, room location, and any uploaded photos are processed by our AI system to generate a diagnostic output. Photos are processed locally on our servers and are not transmitted to third-party AI providers unless explicitly disclosed.

EXIF metadata (including GPS coordinates and device information) is automatically stripped from uploaded photos before processing to protect your privacy.

Governing law and jurisdiction

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email to the address on your account. Continued use of the service after a material change constitutes acceptance of the updated terms.
